Terms and Conditions

Welcome to A Dire Need, Inc (“we”, “us”, “our”). These Terms and Conditions (“Terms”) apply to all rentals and services we provide, including portable restrooms, sinks, tanks, trailered restrooms and related equipment (“Equipment”). By placing an order, paying an invoice, or using our Equipment, you agree to these Terms.
1. Rental Period
1.1 The rental period starts on the delivery date and ends on the agreed pickup date shown on your quote, order, or invoice.
1.2 Any extension of the rental period is subject to our approval and may result in additional charges.
1.3 If pickup is delayed due to lack of site access or other issues on your side, extra rental or service fees may apply.
2. Delivery, Placement and Pickup
2.1 You must provide accurate delivery instructions, including address, contact person, and access details.
2.2 The delivery location must be safe, level, and accessible for heavy trucks at all times.
2.3 Once Equipment is placed, you may not move it without our prior written consent.
2.4 If we cannot deliver or pick up due to blocked access, unsafe conditions, or incorrect information, we may charge additional fees for redelivery or extra trips.
3. Use of Equipment
3.1 Equipment must be used only for its intended purpose and in a safe, lawful manner.
3.2 You are responsible for preventing vandalism, misuse, or damage by guests, employees, contractors, or the public.
3.3 Do not place heavy objects on Equipment, attach signs or structures without permission, or use open flames or hazardous materials near Equipment.
3.4 Children must be supervised around Equipment at all times.
4. Service, Cleaning and Maintenance
4.1 We will service and clean Equipment according to the schedule stated in your order or quote.
4.2 You must keep a clear path to each unit so our service trucks can safely access them.
4.3 Excessive waste, hazardous materials, or conditions beyond normal use may result in extra cleaning or pumping fees.
4.4 If you notice any damage, malfunction, or unsanitary condition, you must notify us immediately.
5. Customer Responsibilities
5.1 You are responsible for providing safe and legal placement locations, keeping access routes clear, and protecting Equipment from theft or damage.
5.2 You are responsible for any damage, loss, or theft of Equipment from delivery until pickup.
6. Pricing, Payments and Fees
6.1 Prices are shown in your quote or invoice. Payment is due in full before or on delivery.
6.2 Late payments may incur late fees or collection costs. Additional fees apply for extra service or blocked access.
7. Cancellations and Changes
7.1 Cancel or change orders by contacting us at 386-325-6188.
7.3 Cancellations less than 3 days before delivery may be subject to a fee.
8. Permits and Compliance
8.1 You are responsible for securing any required permits for placement.
9. Limitation of Liability
9.1 Our liability is limited to the amount paid for the affected rental period.
10. Indemnification
10.1 You agree to indemnify A Dire Need, Inc from claims arising out of your misuse of the Equipment.
11. Force Majeure
11.1 We are not liable for delays due to severe weather or events beyond our control.
12. Governing Law
12.1 These Terms are governed by local and state laws.
13. Changes to These Terms
13.1 We may update these Terms periodically.
